Eh. I doubt Banpresto dissolves until the moment Namco's new fiscal year starts (April). That is more than enough time to negotiate the rights to AT2, if not translate and release it.
However, I AM worried about AT3 given the tight grip Namco keeps on their properties. Namco will want the US rights (used or not) and Gust will want to sell NISA the US rights. I do not know who owns what so... we'll see what happens.

I don't think this is anything to worry about. Banpresto is a Japanese publishing company. Gust owns the actual rights to Ar Tonelico 2, and I really doubt that they had any sort of articulation with Banpresto stating that Banpresto would be involved with a North American release.
Besides, even though a merger is occurring, Namco-Bandai has actually owned Banpresto since early last year, even before the North American E3 announcement that Ar Tonelico would be published in North America by NISA, to eventually be released in February of 2007.
I'm really not worried about this at all.

1 more ar tonelico aint finish yet with two so 3 would make a very huge impact if banpresto really gets dissolved by april next year...

Regarding space, there's always the option of making the game dual layer (like xenosaga or gta3), though I don't know what costs that could add to production.

Cost doesn't really matter.
I would be willing to pay 10 bucks more or so for Japanese option.
And mostly for Ar Tonelico.
