Slander Policy
this topic will go to the general info forum shortly.
to all: the Polymath administrators do NOT condone slander. please refrain from posting information on this forum that is malicious and/or defamatory to any or all posters.
we will assume that you will take the time to read this message. posting material that would subject Polymath or its administrators to lawsuit will result in permanent banning from the board.
this policy is effective from now on.

Because we are in "legal land", I feel the need to comment. First, what do you mean by "malicious". Because you have made the grounds for banning to be an "and/or", either defamatory OR malicious "information" is punishable. I would say that calling someone a vile name, or intentionally parodying someone would be "malicious". Being called an effing moron and idiot would be malicious.
More clarity please
Next, how are you going to know if a comment is defamatory? First, truth is a defense to defamation. Who are you going to believe and why? Wralst, please don't take offense here, because I fully suspect that libby lied about your military history, but that requires me to believe you and not him, in order to get to the conclusion that he defamed you. On what evidence? Your word? I don't think that is sufficient basis. IMO. Defamation also requires actually damages. How is someone actually harmed by a lie about them on an ananymous message board?
Banning is a bad idea. If someone says something wrong, contest it and let the members decide who to believe

Well professionally I am in loss control in the liability insurance world so here's the definition:
Insurance Dictionary: Defamation of Character
Oral or written statement that results in injuring the good name or reputation of another, causing that individual to be held in disrepute.

Pretty broad definition.
If I say that a particular poster must be on drugs because everything they say is totally nuts - I get banned. It impune their character.
If I say that a particular poster is clearly mentally deficient and nothing that comes out of their mouth (fingers) is credible because they obviously are learning disabled - I get banned.
If I say a particular poster is malicious racist ...
If I say a particular poster has sex with dogs ...
...

How can I be harmed if someone posts a wrong or made up address or phone number or work place about me? No one can track me down from that.
How are you going to know if personal history or work history is true except by picking sides in a fight?

ok I see what you mean.
in the case of posting personal information, that is malicious.
in the case of posting erroneous information, that is defamatory.
I don't want anyone here publishing information that might subject me or the board to lawsuit. according to wralst, libby's posting about wralst's record is a crime.
